  • American Bar Association 4-4.1 Duty To Investigate

    Standard 4-4.1 DUTY TO INVESTIGATE

     

    (a) Defense counsel should conduct a prompt investigation of the circumstances of the case and explore all avenues leading to facts relevant to the merits of the case and the penalty in the event of conviction.  The investigation should include efforts to secure information in the possession of the prosecution and law enforcement authorities. The duty to investigate exists regardless of the accused person’s admissions, or statements to defense counsel of facts constituting guilt or the accused person’s stated desire to plead guilty.

     

    Effective investigation by the lawyer has an important bearing on competent representation at trial, for without adequate investigation the lawyer is not in a position to make the best use of such mechanisms

    as cross-examination or impeachment of adverse witnesses at trial or to conduct plea discussions effectively.  Failure to make adequate pretrial investigation and preparation may also be grounds for finding ineffective assistance of counsel.

     

    Police, when handling a criminal investigation, will find enough evidence to support the arrest and potential conviction of a suspect, but they will not necessarily pursue exculpatory evidence for that same subject, or search for ALL evidence.  A Criminal Defense Investigator is an impartial and unbiased proponent for the truth.  He pursues questions relative to guilt as well as due process issues by conducting an impartial and objective search to uncover and evaluate all available evidence and facts related to the question of guilt or innocence. He can confirm or dismiss an alibi, may develop alternative suspects, can confirm or discredit credibility of witnesses, and can call upon experts and focus on specific issues.

     

    Black’s Law Dictionary defines Reasonable Doubt as the degree of certainty required for a juror to legally find a defendant not guilty.

     

     According to Alan Dershowitz,

    “ If the defendant probably did it, the jury must acquit. Probably is not enough to satisfy the burden of beyond a reasonable doubt.”

      However, it does satisfy the measure of a preponderance of evidence in a civil case”.  The police only need “probable cause to believe a crime has been committed” to make an arrest, which falls well short of “proof beyond a reasonable doubt.”

     

  • 6th Amendment of the Constitution of The United States

    In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the state and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the assistance of counsel for his defense.

We offer fast, reliable, legally compliant service of all kinds of legal documents;

Our service is often a fraction of what other service providers charge.  We cover all portions of Delaware County.  We will also gladly travel outside of that area for those “difficult to serve” locations, and we have agreements with other area Process Servers to avoid duplication of effort and keep charges and expenses down for our customers.  We usually make the first attempt within 24-48 hours of receipt of documents, but Rush or Expedite Service is available.  For those clients with a large consistent case load, we do have a Flat Fee service available.

All service agreements include up to 3 service attempts then "nail and mail" if requested, including early morning, late night and weekend attempts.  We can document service by photograph or video as possible upon request.  Affidavits of service are included as a part of the serve, and court filing is also available.

Surveillance

There are many needs for surveillance, whether a cheating spouse, workman’s comp or insurance fraud, custodial disputes or employee investigations.  We utilize multiple vehicles and techniques to work difficult rural surveillance to give you the best possible results, and we aren’t afraid to tell you what can and can’t be done.  There are times when you want a surveillance performed but don’t actually need one, or want a quick Internet search but need boots on the ground to make the case.  We don’t want to waste our time or your money; we will honestly advise you on the case and allow you to decide on your own the best course of action.
